The federal government has taken administrative steps to help full control of a huge Russian cargo plane parked in Toronto, which Ottawa hopes to use to generate financial support to Ukraine.

“This seems that the government is preparing to confiscate that plane,” said William Billern, an Ottawa commercial lawyer with McMillan LLP.

He says he expects “the government to move very quickly in this confiscation, unlimited” by requesting an order from the court to present the property of the crown.

In June 2023, the federal government officially seized a plane sitting at the airport runway at Pearson International Airport in Toronto since February 2022. The plane has not moved in 25 months.

Antonov An-124, the Russian recorder, is owned by Volga-Dneper, which Canada was imposed on. It is one of the largest aircraft in the world, and Ottawa is afraid that Russia can use it to connect military supplies in its invasion of Ukraine.

In June 2023, Ottawa issued an official order for the cabinet to seize the plane, before the official court operation to be subjected to the crown. At that point, Moscow warned that relations with Canada were “about to cut.”

As for the news that affects Canada and around the world, he participated in the urgent news alerts that were delivered directly when it occurs.

Months later, Ottawa fell effectively from the request of the original cabinet and reviewed it, to apply it to the foreign subsidiary companies of Volga-DNeper. This includes the punishment of companies -based companies based in Ireland and the Netherlands, as well as individuals suspected of the Canadian government from the “monarchy interests” in the plane.

Changes appear in an order in the council as well as notice of the Official Gazette, both of which are dated February 14.

“Usually when (company) is punished, all its subsidiaries are explicitly punished. Therefore, you will not be punished for affiliated specializations, especially non -Russian companies, under Russian regulations.”

He said that it seems that Canada is trying to “make sure that it has everything it needs when it moves to the court” because the two organizational changes “are meaningless, unless the government is about to officially lose that plane to the crown.”

Russia has claimed that Ottawa is completing illegal confiscation, and Volga-Dinper claims that Canada violates the 1989 foreign investment protocol conditions that Moscow signed with Ottawa, which has applied since the days of the Soviet Union.

The company claimed last August that Canada cost it more than $ 100 million

Mark Kirsten, a professor of international law at the University of Fraser Valley, said it was “wonderful” that has not already raised Ottawa paper to completely control the plane, after more than a year of seizing the property and pledging full control of this.

He said: “These movements by Canada have the ability to create incredible precedents,” saying that Ottawa must update Canadians regularly on its efforts to seize Russian assets and send revenues to Ukraine.

It is not clear whether Ottawa will sell the plane in its current state, or use it to generate profits or strip the plane to the parts. Kirsten noticed that it is possible that the plane is not able to fly in its current state, given the need to keep the planes and transport them regularly to be operation.

Canadian press contacted global affairs in Canada and the Russian embassy in Ottawa to comment.

Canada is the first country of G7 to submit a law that allows it to seize the assets that people who have been approved and converted returns into a victim of an attached system.

A report in the Senate warned last month that the law could endanger Canadian companies, and can undermine the rule of law if the rulings are not imposed through due legal procedures.
